Emergency Louisiana Protective Orders

Emergency Temporary Restraining Order

When an emergency situation happens and someone believes they are in danger, but the court is not open, an emergency temporary restraining order (TRO) may be sought. A judge will evaluate a case and issue a TRO if it is determined that there exists an immediate and present danger of abuse. To come to this conclusion, the judge will assess potential past abuse and threats in addition to the current case facts. When an emergency TRO is issued, the individual who receives it must come to the court the next day during court operating hours to request either a temporary restraining order or a protective order.

Temporary Restraining Order

When an immediate and present danger of abuse is determined to exist after a judge assesses all the details surrounding a particular case, a temporary restraining order (TRO) will be issued. The individual against whom the TRO is issued will be notified, and a court hearing can take place in as little as 21 days. When the court hearing takes place, the TRO will expire, and both sides can make their case.

Long-Term Protective Order

In situations where the court believes that an individual needs a permanent solution to protect them from imminent abuse, a long-term protective order will be issued. These injunctions can last as long as 18 months but can be extended if necessary.
